Citizens Against Lawsuit Abuse, a non-profit grassroots organization
with about 9000 activists in Los Angeles, today named the exploding
Pop-Tart in New Jersey the "Loony Lawsuit of the Month."
The incident involves a New Jersey couple suing
the Kellogg Company and the Black and Decker Company, the toaster-maker,
for $100,000 in damages to their home after an unattended Pop-Tart
supposedly burst into flames in their toaster.
"It's amazing the courts would have to deal
with such nonsense," stated Michael Vallante, Executive Director
of CALA. "The fact that the couple's lawyer would describe a Pop-Tart
as a blowtorch tells anyone how ridiculous this lawsuit is."
Vallante noted that the box states not to leave
the toaster unattended, and that the woman involved in the suit
freely admits she left the house and left the toaster unattended.
"You would think that this couple would be embarrassed by their actions and their claim of an exploding Pop-Tart. This is the kind of loony lawsuit that clogs our courts and delays cases for people with real grievances. It looks like this couple and their lawyer want a little sweeter breakfast than just a Pop-Tart," said Vallante.
