Dear Editor:

Re: "California is Proof: Medical Malpractice caps Don't Work" -commentary

 

In addressing the Medical Injury Compensation Reforms Act of 1975 (MICRA), it's interesting that Jamie Court asserts a problem exists and the only solution is to "raise the cap" when MICRA is one of the best consumer protection measures ever passed by the Legislature. It has succeeded in keeping the cost of medical malpractice insurance under control. That, in turn, has helped keep health care costs down for consumers.

 

To truly believe that lifting MICRA's cap will benefit Californians is to suggest that our legal system exists solely to create wealth for Mr. Court's personal injury lawyer friends.

 

MICRA works, and I applaud President Bush for acting to protect access to care for all Americans. If Mr. Court really wants what is in the best interest of Americans, he ought to support this kind of common sense reform. Otherwise, he doesn't speak for the 300 million Americans who rely on access to quality, affordable healthcare.
